A 43 year old man from Murray identified as Nickolas Michael May is going to be in prison for one year for running down a group of teenagers in a Washington City parking lot with his RV.
According to the report, he was sentenced to serve 36 months of probation after his one year jail term. He was also ordered by the court to pay restitution to his victims. His sentence was handed down by a 5th District Court judge last Tuesday, September 17.
According to the report, May pleaded guilty in June to two counts of aggravated assault, one a second-degree felony, a third-degree felony, and one count of third-degree felony DUI.
May also admitted to authorities that he drank 13 beers prior to the incident in the Walmart parking lot. He did not provide any explanation why he committed that act.
His plea-agreement documents reflected that sometime on May 23, 2012, he drove his motor home into a 16-year-old boy. Allegedly he also hit the parked SUV the youths were standing beside. The report added that witnesses told police that the RV’s awning pole fell on the boy, pinning him against the RV.
The young adults involved in the incident told the police that they were talking in the parking lot and saw a light-colored RV coming towards them (this according to a probable cause statement filed in court.) The teenagers also stated that May was smiling and laughing as he drove straight to them.
May was originally charged with one count of aggravated assault, a second-degree felony; three more counts of aggravated assault, all third-degree felonies; driving under the influence, a third-degree felony; causing an accident involving injury or death, a Class A misdemeanor; and reckless driving, a class B misdemeanor. By entering into a plea bargaining agreement, his charges were reduced to two counts of aggravated assault, one a second-degree felony and the other a third-degree felony, and one count of third-degree felony DUI.
