Herbicide Battle

dead treeIn 2011 Greenleef enterprises recognized that dozens of their customers were experiencing yellowing and decay in their trees and bushes. After investigation into the cause the Heber County company filed a law suit on behalf of its clients against DuPont Co. They found that the herbicide, Imprelis, used had been spreading to unwanted areas and killing precious and expensive decorative trees.  DuPont had already taken Imprelis off the market by the time this complaint had reached them due to damage done to other cities closer to their Delaware headquarters. The U.S. Environmental Protection Agency forced DuPont to take Imprelis off the market in August of 2011.

The law suit originated by Greeleef has since been settled but dozens of home owners in Park City have recently rejected the class action settlement. DuPont has agreed to spend up to nine hundred million replacing damaged trees. Park City residents are rejecting this claiming that the damages done to them cost ten times that. They feel that the compensation, though a necessary gesture, is inadequate.

We at Christensen & Hymas hope that both sides will be able to come to an agreement which they feel is fair and are thankful that this misuse of chemicals only lead to the death of trees and not humans.

Woman Stabbed in the Neck, Recovering

Folding KnifeLast Tuesday night in Salt Lake City, a 40-year-old woman was stabbed in the neck. She was walking home around 8:15 p.m, and the attacker came up behind her. The incident occurred behind Faustina Restaurant in a driveway. The man approached her with a weapon, a man she did not know.

Detective Dennis McGowan of the SLPD recounts the scene: “she felt what she described as punches, turned out later she was being attacked with a sharp weapon… She fought this person and struggled hard, yelled out and the person fled.”

The victim ran into Faustina, asking for help. A doctor who had been dining at the restaurant was able to help her, while an employee called 911. Jared Young, the owner of Faustina described the scene as quite jarring: “a woman came in with blood down the side of her which is pretty startling.”

The woman is currently in the hospital for the injuries to her neck and face, but she is doing well. There are still investigations as to who the attacker was, and what his motives were.

While police say the did everything right: she yelled for help, and fought back, but walking alone at night in any city can be dangerous. McGowan said, “We urge everyone whenever they are out and about alone especially to be alert to your surroundings and what’s going on around you.”

Perhaps the best solution is to plan ahead, so that you’re not walking alone at night. Meet with a friend, or ask a co-worker to walk with you, until you can be in a place with people, a place where you would be much less likely to be attacked.

David and Leslee Henson Severely Injured

windshield smashedIn St. George on Monday, a husband and wife, David and Leslee Henson were struck while walking on the sidewalk.

A traffic accident shortly after 9:00 am on Dixie Drive just north of Sunbrook Drive had police responding. A car headed southbound on Dixie drive rear-ended another vehicle, which caused the front vehicle to veer into the side of the road. Unfortunately David and Leslee were crossing the street as pedestrians at that exact moment of the crash.

A helicopter had to transport 56-year-old David Henson to the Dixie regional Medical Center, and was died at the hospital. Leslee, also 56, was taken to the local hospital by ambulance, but later transferred for more treatment to Salt Lake City.

Both drivers had minor injuries, and were also taken to the hospital. Investigation is still pending to try and reconstruct the incident. The county attorney will determine what charges will be filed.

St. George Rollover Puts Woman in Critical Condition

Ambulance truckIn St. George this last weekend, Sunday afternoon, a woman was traveling on I-15 when she crashed. At around 4:30 pm, the 25-year-old driver drifted from the center of the road, then over-corrected, forcing the vehicle to roll. Her name is not available as of Sunday, but she is from the St. George area. According to the Utah Highway Patrol statement, she was not wearing a seat belt and was ejected from the car.

The women was in critical condition, and a strong possibility of being paralyzed. Alcohol is not  currently not a factor at this moment in the investigation. I-15 shut down for 45 minutes while emergency teams responded to the scene, including a medical helicopter.

Guy Lauritzen Rams Police Car

Traffic accident_car and truck_police officerYesterday around 2:15 pm, Taylorsville police responded to a report of an assault where a gun might have been involved. The man allegedly involved in the assault, left with a possibly stolen gray Dodge pickup truck.

The truck was seen at 3900 West and 5400 South, the license plates confirmed the vehicle was stolen. Police followed into a Little Ceasars parking lot at 3950 W and 5400 S.

An officer parked in the stall behind the driver, in an attempt to take him into custody. At this point, the driver, 49-year-old Guy Lauritzen, consciously began backing out of the parking stall. Lt. Justin Hoyal of the UPD said the officer tried to stop him by performing a pit maneuver, but the maneuver failed. “The suspect then pulled out and rammed on of or police cars at a high rate of speed,” said Hoyal.

Three officers were able to box him in, and bring him to a stop. However, as the officers were trying to take Lauritzen into custody, his Rottweiler dog jumped and aggressively came charging at the officers. The policemen being attacked attempted to kick the dog away, but it aggressively continued, and they were forced to shoot the dog on the scene.

The man was arrested on suspicion of multiple felonies, including, assault and fleeing, aggravated assault on a police officer, and possession of  a stolen vehicle.

Marti Hall’s Body Identified at Construction Site

construction site_trucks_snowOn Wednesday, the body of a woman was discovered in a Riverdale construction site. Kurt Nalder, an owner of the fourplex under construction, gruesomely found the body of 46-year-old Marti Hall. Nalder said, “When I pulled up, I noticed some purple on the side of the fourplex. I looked at it for another second and I realized it was her hand just sticking out above her so I just called 911.”

The body did not show obvious trauma signs, she was fully clothed, and did not appear to be homeless.  Tracks in the snow make police believe she lived near close by.

She was removed from the site around 10:00 am. The case is under suspicion until the cause of death is definitively determined. Local residents are being asked to assess any missing neighbors. Lt. Scott Brenkman of the Riverdale Police Department said, “It’s always suspicious when you find a body out in the elements in a yard like this.” The police at this point say that Hall might have fallen at the construction site, and died because of the freezing temperatures.

Fatal Injuries in Pedestrian Accident in Salt Lake

A pedestrian accident occurred Saturday night in Salt Lake in which a woman died while crossing the street. According to KSL, a 39-year-old woman was walking “in very close proximity to a crosswalk” at she crossed 300 East at 2763 South when she was struck by a male driver. The woman was apparently taken to the hospital where she was pronounced dead. Alcohol does not appear to be a factor in the event; there is, in fact, no clear indication at this point of what caused the accident.

Weekend Accident on Bangerter Highway Kills Yesica Moreno

A 20-year-old woman from West Jordan was killed Sunday morning after her pickup truck crossed into southbound traffic and struck the side of a semi tractor-trailer. KSL reports that the accident occurred around 6 AM on Bangerter Highway near 2350 South. Unfortunately, after being airlifted to a nearby hospital, Ms. Moreno was pronounced dead due to injuries received in the accident; the reason for which Ms. Moreno’s truck drifted into the oncoming lane is not known. The driver of the tractor-trailer did not receive any injuries in the incident.

The measure of grief following any loss is great, but especially so when there seem to be so many questions about the accident. We hope that Ms. Moreno’s family will receive increased understanding in the near future concerning the accident, perhaps being able to find some measure and solace through this. Box-Truck Accident in Centreville Leaves One Dead

The accident happened in Centreville, UT, around 6 AM on 1-15 near milepost 321. KSL reports that the man’s car lights were not turned on, and his vehicle was moving slowly at the time of the impact. The collision forced both the man’s vehicle and the box truck in oncoming traffic, where they struck a semitrailer. The man, whose name has not been released, is believed to have died on impact.

Motorist Brandon P. Phillips Dies in Semi Accident

Personal Injury Attorney in UtahA motorist died this evening after his vehicle rear-ended a semitrailer near milepost 355 in Willard, Box Elder County, UT. Brandon P. Phillips of Brigham City rear-ended the semi around 5:15 after traffic had been slowed due to another accident. According to KSL, evidence appears to show that Phillips made no attempt to slow before hitting the semitrailer, the driver of which was not injured in the accident. Witnesses also say that there did not appear to be any form of distracted driving involved in this accident.
