Cecily Fields in Critical Condition after Accident

Monday, April 1st, 2013

Police Line Do Not CrossKUTV brings us a story from Tuesday night, where in Midvale, Utah a woman was taken to the hospital in critical condition. Around 9:30 pm, 22-year-old Cecily Fields and a friend were walking across State Street near 8000 south. Police report that there was no crosswalk where they were passing, the street was poorly lit,  and the two were trying to walk across several traffic lanes.

The driver who hit Fields was 20 years old and stopped at the scene. Cecily was taken to Intermountain Medical Center in critical condition. Her friend fled from the scene. But police were able to track her down. She admitted to leaving the scene because the two of them had been drinking, and she was afraid she might be held responsible.

It is illegal, and dangerous to drive a vehicle under the influence of alcohol, but what people might not necessarily know is that walking under the influence is incredibly dangerous as well. According to an article from Alcoholism Rehab, “alcohol impairs not only your ability to drive, but also your ability to walk. Drinking impairs coordination, reflexes and the individual’s judgment.”

Over the course of a 25-year-study, 58% of pedestrians killed on New Year’s Day had high blood alcohol concentrations. In an article by SunSentinel.com, 13% of all pedestrian deaths in 2010 involved the pedestrian drinking.

If you’ve had a drink, it is the responsible thing not to drive, but consider being safe all around. When you drink and drive, you have a high probability of causing harm to another person, but when you walk under the influence, there is a very high chance you could hurt yourself.

Keep yourself and everyone around you safe when drinking, and stay out of the roads.

If you have any questions or concerns related to an accident that occurred in part because of alcohol, please call Christensen & Hymas: 801-506-0800. We’d be more than happy to give you a free consultation, and help you figure out your next steps.

Teen Struck at Busy Crosswalk

Wednesday, March 13th, 2013

Crosswalk sign - push button for lightA story brought to us by Fox News shares the tale of a 15-year-old boy in Kearns, Utah, in now in critical condition. Tuesday, March 12th, at 7:15 am,  a group of teenagers were crossing at 5300 W and 5400 S on their way to Kearns High School. One car stopped suddenly to avoid the group of pedestrians, but a second came around and swerved into the boy. Unified Police Department Lt. Justin Hoyal said the kids had not been using a crosswalk. A woman who lives nearby, Amanda Simpson, told police that many students cross on that street every day on their way to school. While this is a main road, Simpson thinks the authorities need to reduce the speed limit because of all the kids walking around on a regular basis. She thinks it is not safe to keep it at the current 40 mph.

There is not a single crosswalk on 5400 South, and the Utah Department of Transportation claims there is no need for one. The past three to four year, the UDOT has conducted several studies with various factors, strongly considering the amount of pedestrians. Department spokesperson Adan Carrillo said that the situation of the road does not, “meet the warrant for an installation of a crosswalk or traffic signal at this point.” The results of the many studies did not signal the need to add any safety measures. However, the UDOT is still planning on researching the stretch of road on 5400 South, and the potential addition of road signs or safety precautions.

Maria DeAquino Struck Dead as a Pedestrian

Monday, March 4th, 2013

Police officers at scene of accidentThis weekend, 26-year-old Maria DeAquino was hit while crossing the street. South Salt Lake Detective Gary Keller thought that DeAquino may have crossed the street outside of a crosswalk, probably en route to her normal bus stop.

Police say that around 7:15 pm on Saturday, March 2nd, a Toyota Prius struck her as she was crossing on 3605 S. State Street. She was immediately taken to the local hospital in critical condition. Later that night she died. Police are still in the throws of the investigation, so far no charges have been filed.

Pedestrian accidents are more frequent than anyone would like.

According to Legal Catch law information, about  5,000 pedestrians are killed, and another 64,000 pedestrians are injured due to motor vehicle accidents every year in the United States. While many accidents take place at intersections, the majority occur NOT in intersections. This is due to the fact that vehicles travel at higher speeds, and are not expecting to stop in non-intersections. Over 70% of pedestrian deaths one year took place on major roads, including freeways and interstate highways.

Both pedestrians and a motor vehicle drivers need to be aware of each other. Both parties need to carefully follow road signs and signals.

Even if you are extremely cautious, unfortunately sometimes accidents still happen, and if you or a loved one has been in an accident, you may need an attorney. Call Christensen & Hymas for a FREE consultation as to what your next steps should be. Guy Lauritzen Rams Police Car

Thursday, February 28th, 2013

Traffic accident_car and truck_police officerYesterday around 2:15 pm, Taylorsville police responded to a report of an assault where a gun might have been involved. The man allegedly involved in the assault, left with a possibly stolen gray Dodge pickup truck.

The truck was seen at 3900 West and 5400 South, the license plates confirmed the vehicle was stolen. Police followed into a Little Ceasars parking lot at 3950 W and 5400 S.

An officer parked in the stall behind the driver, in an attempt to take him into custody. At this point, the driver, 49-year-old Guy Lauritzen, consciously began backing out of the parking stall. Lt. Justin Hoyal of the UPD said the officer tried to stop him by performing a pit maneuver, but the maneuver failed. “The suspect then pulled out and rammed on of or police cars at a high rate of speed,” said Hoyal.

Three officers were able to box him in, and bring him to a stop. However, as the officers were trying to take Lauritzen into custody, his Rottweiler dog jumped and aggressively came charging at the officers. The policemen being attacked attempted to kick the dog away, but it aggressively continued, and they were forced to shoot the dog on the scene.

The man was arrested on suspicion of multiple felonies, including, assault and fleeing, aggravated assault on a police officer, and possession of  a stolen vehicle.

Marti Hall’s Body Identified at Construction Site

Wednesday, February 27th, 2013

construction site_trucks_snowOn Wednesday, the body of a woman was discovered in a Riverdale construction site. Kurt Nalder, an owner of the fourplex under construction, gruesomely found the body of 46-year-old Marti Hall. Nalder said, “When I pulled up, I noticed some purple on the side of the fourplex. I looked at it for another second and I realized it was her hand just sticking out above her so I just called 911.”

The body did not show obvious trauma signs, she was fully clothed, and did not appear to be homeless.  Tracks in the snow make police believe she lived near close by.

She was removed from the site around 10:00 am. The case is under suspicion until the cause of death is definitively determined. Local residents are being asked to assess any missing neighbors. Lt. Scott Brenkman of the Riverdale Police Department said, “It’s always suspicious when you find a body out in the elements in a yard like this.” The police at this point say that Hall might have fallen at the construction site, and died because of the freezing temperatures.

Our deepest condolences go out to Marti Hall’s family and friends. An accident like this can turn a world upside-down. The twists and complications of being in the legal system dealing with a death can be overwhelming. If you or a loved one has been involved in an accident of this kind, you may need the guidance of an attorney. The accident attorneys at Christensen & Hymas would be more than willing to talk to you about your case. Call 801-506-0800 for a FREE consultation.

Hit and run SUV crash leaves Provo student with serious injuries

Thursday, January 10th, 2013

Debris from dark BMW SUV

On 500 North in Provo, there is a new luxury student apartment complex, The Village. Foot and vehicle traffic has increased substantially since its opening, however, the streets are not well-lit, and young Provo residents often find themselves at risk.

Unfortunately, sometimes accidents are made worse by the driver fleeing the scene – a hit and run. On Wednesday, December 12, a 22-year-old BYU student was crossing 500 North at 300 East in Provo when she was struck by an SUV, leaving her with a fractured skull which necessitated a hospital stay. The driver of the dark blue BMW-brand SUV did not stop to assist the student, but plenty of detritus was found at the scene.

Almost 1 in 5 pedestrian deaths are hit and run scenarios. The young and the elderly are disproportionately likely to be victims of a pedestrian crash accident. Five- to nine-year-olds and those over seventy are more likely than other groups to be hit and killed by a car while walking.

Speed is a factor in pedestrian deaths. A pedestrian hit at 40 mph has an 85 percent chance of being killed, while at 20 mph, the fatality rate drops to 5 percent. The area south of BYU campus is known for drivers breaking the speed limit. Using common sense to decrease your speed while driving through residential neighborhoods, which are likely to have people walking, decreases your chance of hitting a pedestrian.

The personal injury lawyers at Christensen & Hymas extend their condolences to any victim of a hit and run accident in Utah. It’s cowardly, it’s illegal, and it’s just plain wrong. We wish the young woman a speedy recovery. Any witnesses with information should call Provo police at 801-852-6210.

Pedestrian Homeless Man Killed by Car

Monday, January 7th, 2013

Hit and run pedestrian accidentRecently in South Salt Lake, a sedan-style car hit a homeless man and his motorized wheelchair. The victim, Raymond Nielson, was 59 years old. He regularly traveled on 700 East, pulling or pushing a small cart containing his belongings. On his regular route, Wednesday, he was on his way to visit a relative when he was hit.

Unified Police detective Ken Hansen said that the wheelchair appeared to be in the center lane of traffic when it was hit, though it is unclear whether Nielson was crossing the street or going with traffic in the roadway.

The driver told police that he believed he’d hit something in the road, at first he did not know what had happened. The car only had damage on the lower front bumper on the driver’s side. But Detective Hansen is investigating why the driver was unaware he had struck a wheelchair.

Nielson’s belongings were all along the roadway, spilt out more than a block from the impact. His cart found further down the road. The wheels from the chair were completely severed.

This tragedy is an example of increasing pedestrian accidents in Utah. While this case is still under investigation, if this turns out to be a case of driver negligence, Nielson’s family, or the family of someone who might have been in a similar accident, may be entitled to some sort of compensation. Such an accident will most definitely have long-term emotional and financial consequences.

Personal injury attorneys at Christensen & Hymas law firm work closely with clients affected by the terrible costs of negligent driving. Insurance companies are infamous for skimping on settlements victims deserve, but a pedestrian accident lawyer knows the full value of your case, and will fight for it.

Tragic Pedestrian Accident Claims Life of Edwin Cardoso

Wednesday, October 24th, 2012

A terrible accident occurred this morning in Salt Lake City, UT. According to KSL5 and FOX13, 15-year-old Edwin Cardoso was walking to school around 7 AM when he was hit by a utility truck turning left. Both the boy and the driver had a green light, yet the driver failed to yield to Cardoso, who had the right-of-way and was also in a crosswalk at the time of the accident. The boy suffered head injuries, and less than two hours was pronounced dead.

Words of condolence fall miserably short at such a time. On behalf of Christensen & Hymas, we wish to say we are truly sorry to the family for this loss.

In circumstances such as these, it is crucial for the family to know that they may receive compensation to help cover the costs of medical bills and other costs related to the loss. This can be a very, very expensive time, especially since no one plans to lose a loved one. Often adding insult to injury, insurance companies will show up days after the event and offer a ‘settlement’, neither leaving time for the family to grieve nor offering an amount that will even begin to help defray the costs. Call the pedestrian accident lawyers at Christensen & Hymas if you find yourself being hassled by insurance companies—let us deal with them for you. Call (801) 506-0800 for a no-commitment free consultation.

Dorthy Bagley Killed in Pedestrian Accident

Wednesday, September 26th, 2012

Wrongful Death AttorneyA tragic accident befell pedestrian Dorthy Bagley early this morning when was she hit by a vehicle while crossing 1000 North near 1450 West in Salt Lake City. Ms. Bagley, 81 years old, had just parked her car of on the side of the road when, according to Salt Lake Police Lt. Scott White, “she ran across the street,” though for unknown reasons. She was struck by a man driving a minivan, who again, according to Lt. White, “he [the driver] had no idea anyone was in the road.” Ms. Bagley was taken to the hospital and pronounced dead a short time later. It is thought that perhaps rain played a role in the accident, though this is unknown for sure.

Any time an accident occurs and a life is taken, our hearts go out to the family and friends of the deceased. Likewise, we offer our condolences to Ms. Bagley’s family; losing a family member is a great loss, especially in such tragic circumstances.

Unfortunately, accidents like these happen often. Indeed, as attorneys, we see them almost every day, and we know the burden that comes with them. Paying the bills at such a time, even having to worry about money, seems superficial and disrespectful to the deceased. But from our perspective, knowing how insurance companies write off these losses for nothing because they happen so frequently, it is likely you may want and need help at such a time, if for nothing more than to keep insurance companies off your back. As your wrongful death attorney, we will take on ALL contact with the insurance company, and will ensure a settlement that will at once pay the bills and costs associated with the loss of your loved one, and compensate you for your associated pain and suffering. Let us be your advocates; we promise compassion and integrity, and not every lawyer can say that. Call us today at (801) 506-0800.
